On the 9th July, M. Hackwood wrote to me repudiating the cross-section and stating that Messrs. Leigh and Fraser had no authority to act for the Company without the approval of the Government, which had been submitted to The Attorney General, I intimated to Mr Hackwood on the 20th July, that the cross-section referred to was the one deposited by his company and was to be adhered to.
Before anything further transpired, the Secretary of State's despatch, No. 302 of 14th August, 1908, was received, in which directions were given that the requirement as to concreting the full width between the two tracks was to be waived.
After the receipt of these instructions I recognized that an approved cross-section no longer existed and I refused to issue any further permits for the work to proceed until new cross-sections were deposited and approved of by me.
I may add that any confusion or misunderstanding in this matter has arisen from the Company's neglect to instruct their local agents properly and from their attempt to coerce me into approving a section which was condemned by me when it was first submitted by Colonel Boufle.
